Abstract(s)
Perante a visibilidade que o crime de violência doméstica tem vindo a obter junto da
sociedade, bem como o aumento do número de casos reportados às entidades policiais e o
desfasamento existente entre estes e o número de casos julgados, considera-se útil um estudo
sobre os fatores associados à tomada de decisão sentencial. A presente investigação visa contribuir nesse sentido, sendo o seu principal objetivo a
identificação dos fatores evocados por parte dos juízes para fundamentar a decisão sentencial, bem como a determinação da medida concreta da pena. Para tal, foi efetuada uma Análise
Temática de 60 acórdãos pertencentes a 5 comarcas diferentes. Tendo por base a literatura especializada, assim como o material analisado, foram
identificados dois conjuntos de fatores significativamente associados às decisões judiciais, no
âmbito dos fatores legais e extralegais, organizados em três temas principais: (i) Crime; (ii)
Pena; e (iii) Arguido. Em geral, foi possível verificar a presença de fatores legais e fatores extralegais, estes
últimos essencialmente ligados diretamente ao arguido.
ABSTRACT: The visibility that the crime of domestic violence has been obtaining in society, as well as the increase in the number of cases reported to the police authorities and the gap between these and the number of judged cases, is considered useful a study on the factors associated with sentencing decision-making. The present investigation aims to contribute to this sense, its main objective being to identify the factors evoked by the judges that justify the sentencing decision that influence the sentencing decision-making, namely in terms of the judicial outcome, as well as in the determination of the concrete measure of the penalty. To this end, a Thematic Analysis of 60 judgments belonging to 5 different districts was carried out. Based on the specialized literature, two sets of factors significantly associated with judicial decisions were identified, within the scope of legal and extralegal factors, organized into three main themes: (i) Crime; (ii) Penalty; and (iii) Defendant. In general, it was possible to verify the presence of legal and extralegal factors, the latter practically directly linked to the defendant.
