Abstract(s)
Este trabalho foi perspectivado com a finalidade de refletir os efeitos da
institucionalização de jovens em conflito com a lei dos Sistemas de Justiça Juvenil de
Portugal, Brasil e Chile. O sistema juvenil é uma temática que suscita discussões e reflexões
devido às consequências relacionadas a forma com que se aplica uma intervenção em
crianças e jovens, sendo que a institucionalização não promove uma reintegração efetiva, mas
auxilia na construção de maior desigualdade entre os que ali passam. Dentro da triangulação
Portugal, Brasil e Chile foram destacados pontos e práticas em comum ao lidar com a
temática dos jovens em conflito com a lei. O objetivo deste estudo é apresentar relatos de
profissionais que têm/tiveram experiências relacionadas ao sistema juvenil e, a partir disso,
fazer uma observação crítica orientada para a mudança acerca da institucionalização de
jovens. Foi feita a análise temática dos conteúdos que se apresentaram através das entrevistas
semiestruturadas com esses profissionais de forma a levantar as temáticas mais importantes
relacionadas às possibilidades e impossibilidades de reintegração desses jovens que passam
pelo sistema. Com os resultados foram apresentados temas do Sistema Tutelar Educativo;
Centros Educativos; Institucionalização de Crianças e Jovens; Semelhanças com o sistema
penal; Sistema político e econômico; Trabalhadores do Sistema Juvenil; Sugestões para uma
mudança no sistema e Projetos alternativos. Foi possível observar que há falhas estruturais de
políticas públicas que impedem um olhar atento à realidade social, focando apenas no delito,
o que sugere um sistema punitivo próximo da realidade do sistema penal.
ABSTRACT: This work was designed to reflect on the effects of the institutionalization of young people in conflict with the law in the Juvenile Justice Systems of Portugal, Brazil and Chile. The juvenile justice system is a subject that prompts discussion and reflection due to the consequences related to the way in which intervention is applied to children and young people, since institutionalization does not promote effective reintegration, but rather helps to build greater inequality among those who pass through it. Within the triangulation of Portugal, Brazil and Chile, common points and practices were highlighted when dealing with the issue of young people in conflict with the law. The aim of this study is to present reports from professionals who have/had experiences related to the juvenile system and, based on this, to make a critical observation oriented towards change regarding the institutionalization of young people. A thematic analysis was made of the content presented in the semi-structured interviews with these professionals in order to identify the most important themes related to the possibilities and impossibilities of reintegrating these young people who go through the system. The results presented themes of the Educational Guardianship System; Educational Centres; Institutionalization of Children and Young People; Similarities with the penal system; Political and economic system; Workers in the Juvenile System; Suggestions for a change in the system and Alternative projects. It was possible to observe that there are structural flaws in public policies that prevent an attentive look at the social reality, focusing only on the crime, which suggests a punitive system close to the reality of the penal system.
