O presente trabalho procurou perceber a perspectiva do investigador acerca da confissão e
da falsa confissão, recorrendo a entrevistas semi-directivas, efectuadas a 60 investigadores. Para a
sua análise, recorreu-se à análise de conteúdo. Os resultados evidenciaram que os factores mais
importantes para os investigadores, quer para a confissão quer para a falsa confissão, são o
suspeito e o interrogatório, sendo o menos importante o próprio investigador. Também foi
possível perceber que os investigadores consideraram que as técnicas de interrogatório são os
factores mais importantes na obtenção de uma confissão, bem como que os motivos mais
importantes para a realização de uma falsa confissão são, de acordo com a perspectiva do
investigador, a defesa de terceiros por parte do suspeito. O estudo permitiu aprofundar as
questões da confissão e da falsa confissão, especialmente em relação à perspectiva do
investigador.
The present study sought to understand the investigator’s perspective about confessions and false confessions, using semi-directive interviews, applied to 60 investigators. For the analysis of the interviews it was used content analysis. The results showed that the most important factors for investigators, in relation to confessions and false confessions, are the suspect and the interrogation, being the less important the investigator himself. It was also possible to understand that the investigators found that interrogation techniques are the most important factors in obtaining a confession, and that the most important motives for making a false confession, according to the investigator's perspective, was the suspect trying to protect someone else. This study allowed deepening the issues of confessions and false confessions, especially in relation to the investigator’s perspective.
