.Os autores elaboram uma reflexão sobre o sistema
punitivo português nomeadamente sobre os objectivos
das penas vigentes, i.e., a retribuição, a prevenção geral
e a prevenção especial. Destacam em particular as
penas privativas de liberdade, pena de multa e penas
de substituição, analisando as suas vantagens e inconvenientes
à luz das possibilidades de reintegração do
indivíduo no quadro social de referência. Salientam as
penas de substituição que evitam que o indivíduo seja
exposto ao sistema prisional e que veja as suas relações
sociais e profissionais interrompidas.
ABSTRACT: The authors reflect on the Portuguese punitive system, namely the goals of the penalties, which are repayment, general prevention and special prevention. They emphasise in particular penalties that restrict freedom, penalties of fine and penalties of substitution, analysing its advantages and inconveniences given the possibilities of the individual’s social reintegration. Substitution penalties that prevent the individual from the contact with the correctional system and the interruption of social and professional relations are enhanced.
