Abstract(s)
Este trabalho tem como objetivo compreender as tomadas de decisões judiciais por
parte dos magistrados em processos de crime de abuso sexual de menores, mais
especificamente identificar os fatores legais e extralegais que são tidos em consideração tanto
como agravantes, como atenuantes. Subjacente a estes fatores é possível identificar elementos
presentes no processo da tomada de decisão judicial como as crenças e experiências pessoais
e sociais dos magistrados que poderão influenciar estes agentes a basear as suas decisões,
parcial ou totalmente, na maneira como percepcionam o crime, as características do crime,
dos arguidos e das vítimas. Ainda, este trabalho tem como objetivo sensibilizar para as
fragilidades do sistema de justiça relativamente ao processo humano a que os juízes recorrem
de forma inevitável para lá da lei. Este tipo de investigação ainda é pouco explorada em
Portugal, o que torna o seu aprofundamento ainda mais urgente.
Este estudo incidiu sobre 50 acórdãos de crime de abuso sexual de menores onde
constam julgamentos judiciais recorridos. Os acórdãos foram recolhidos através das
plataformas online ECLI e DGSI, compreendidos no período entre 2016 e 2023, referentes
aos vários Tribunais de Relação de Portugal e o Supremo Tribunal de Justiça. Neste estudo, o
método de investigação utilizado foi a análise de conteúdo do teor de cada acórdão.
Concluiu-se que os juízes dão ênfase ao que é obrigatório por lei aplicar nestes casos (fatores
legais) mas, também, foi possível observar que estes profissionais tomaram juízos de valor
sobre os arguidos, o crime e as vítimas, provavelmente com base nas suas crenças e
experiências pessoais, sociais e culturais (fatores extralegais).
ABSTRACT: This investigation aims to understand judicial decision-making by judges in child sexual abuse crime cases, more specifically to identify the legal and extralegal factors that were taken into consideration as both aggravating and mitigating factors. Underlying these factors, it is possible to identify elements presents in the judicial decision-making process, such as the personal and social beliefs and experiences of magistrates that may influence these agents to base their decisions, partially or totally, on the way they perceive the crime, the characteristics of the crime, of the defendants and of the victims. Furthermore, this work's goal is to raise awareness of the weaknesses of the justice system about the human process that judges inevitably fall back on beyond the law. This type of research is still little explored in Portugal, which makes its further development even more urgent. This work was focused on 50 judgments about child sexual abuse crimes, wich are included appealed court judgments. These judgments were collected through online platforms such as ECLI and DGSI, in between the period of 2016 and 2023, referring to the various Courts of Appeal of Portugal and the Supreme Court of Justice. In this study, the investigation method was content analysis found in each judgment. It was concluded that judges emphasize what is mandatory to apply by law on these cases (legal factors) but also it was possible to observe this professionals made value judgments about the defendants, the crime and the victims based on their personal, social and cultural beliefs and experiences (extralegal factors), although this study represents a reduced sample.
