Abstract(s)
O objetivo do presente trabalho foi identificar as
implicações das instituições policiais e judiciárias em
um linchamento ocorrido em uma cidade do interior
brasileiro em que foram executados três suspeitos de
autoria de um homicídio cometido na localidade. A
metodologia utilizada foi o Estudo de Caso, realizado
através da análise do conteúdo dos processos legalmente
constituídos para esclarecer a ocorrência e através
de informações coletadas junto aos meios de comunicação,
entrevistas e conversas informais com
moradores. As evidências processuais que permitiriam
a identificação dos envolvidos no linchamento, foram
obscurecidas por um conjunto de falhas técnicas,
depoimentos inverídicos e negligências que transformaram
os processos em peças de sustentação da impunidade
de seus autores, protegidos pela comunidade e
autoridades. A análise dos processos evidenciou a
construção de uma verdade jurídica que se distanciou
da verdade dos fatos e, além disso, indicou o envolvimento
das instituições judiciárias e policiais com
interesses políticos locais. Na ocorrência analisada o
judiciário abdicou de suas prerrogativas relativas ao
monopólio da vingança e outorgou aos próprios membros
das elites locais o poder de fazer a justiça. O linchamento
estudado se constituiu em um instrumento
de controle social, à semelhança daqueles ocorridos no
Brasil no final do século XIX.
ABSTRACT: The objective of this work was to identify the implications of police and judiciary institutions in alynching case occurred in a Brazilian small town, in which three suspects of a local homicide were executed. The methodology utilized was the Case Study, accomplished through content analysis of the legally instituted processes (established to clarify the occurrence) and through information collected in the media, interviews, and informal conversations with local residents. The legal evidences which would permit the identification of those involved in the lynching were blurred by a set of technical faults, untrue depositions, and negligence, which transformed the processes into supports for the impunity of the authors of the crimes, protected by the community and the authorities. The analysis of the processes pointed out the construction of a judicial truth which furthered itself from the factual truth and, furthermore, revealed the involvement of the judiciary and police institutions with local political interest. In the occurrence analyzed the judiciary abdicated of its prerogatives with respect to the monopoly of revenge and entrusted the local elite members the power to make justice. The lynching case studied constituted an instrument of social control, similar to those occurred in Brazil by the end of nineteenth century.
